Notice of Final Action - Administrative Regulation Regarding Control of Noxious Growths and Undesirable Trees

The April 2005 edition of the Takoma Park Newsletter included notice of the City’s intention to adopt an administrative regulation regarding control of noxious growth and undesirable trees. The regulation provides guidance for compliance with and enforcement of Section 12.08.040 and 12.12.080.B.1 of the Takoma Park Code. The intent of Section 12.08.040 is to protect residents from allergenic plants and protect manmade structures and the urban forest from damage from the overgrowth of invasive plant species. The intent of Section 12.12.080.B.1 is to promote the health of the urban forest by facilitating the removal and replacement of undesirable trees with trees that will make a valuable addition to the urban forest.

The notice of the City’s intention to adopt an administrative regulation was published in accordance with the requirements of the “Administrative Regulations Ordinance” (Authority: Chapter 2.12, Administrative Regulations, of the Takoma Park Code) to allow citizens the opportunity to comment on the proposal. An exact copy of the proposed regulation was available for inspection during regular office hours in the City Clerk’s Office, 7500 Maple Avenue, Takoma Park. The regulation was also posted on the City’s web page.

No comments had been received by the City Clerk's Office until the notice of final action appeared in the May 2006 Takoma Park Newsletter and on the web page. Since that time, a number of comments have been received. The City Council allowed the regulation to take effect as of May 10; however, they will be reviewing the proposed regulation in the fall of 2006. Residents who wish to comment may continue to do so. Comments received will be provided to the City Council in preparation for their review of the regulation.
